Purchase terms and Conditions for the Sewing Circle Membership

Terms and Conditions

The following T’s & C’s apply to any purchase of The Sewing Circle membership.

This Agreement is between us - Natalie Trusler and any authorised team members of Natalie Trusler (“us”, “we”, “Natalie Trusler”) - and you (“The Buyer”) about your purchase of The Sewing Circle Monthly, Quarterly or Annual Membership (“The Sewing Circle).

Agreement

a) By accessing and using the Natalie Trusler and The Sewing Circle website, you agree to be personally bound by these terms and conditions (including any changes or modifications made to them), according to the laws of Australia.

b) By purchasing The Sewing Circle you understand that you are assenting to these terms and conditions.

c) You acknowledge that you are purchasing a single license for this program for your personal, individual use only.

The Program

a) The Sewing Circle includes all materials, content, text and miscellanea comprising and related to The Sewing Circle. This includes but is not limited to: the sales page for The Sewing Circle itself, the content of all lessons, all worksheets, videos, audios, downloads, interviews, the branding and design, the sales emails, the course emails, the community group and all examples provided (except where otherwise specified).

b) We may revise these terms and conditions and/or make changes to the membership and its inclusions.

c) We may introduce future plans, products or services which are not included in the membership.

Your Membership

a) By joining The Sewing Circle, you give permission for images of your creations and feedback you share through social media, via email, in the membership group or elsewhere, to be shared anonymously in our marketing, social media, emails and elsewhere. We will never include your personal details when sharing these testimonials (such as names, profile images, children's photos or other identifying information) without your express permission and consent.

b) Your password will be emailed to you in your welcome email.

c) It is your responsibility to keep these login details safe and private.

d) Your access details may not be passed on to third parties. Passing your access details on to a third party means you will be in breach of this agreement.

e) If your email address or any other relevant details change, it is your responsibility to update those items in the membership portal Menu > My Account > Then adjust your details.

Cancelling your Membership

a) If you would like to cancel your recurring membership, you can do this by filling in The Sewing Circle Cancellation Request form at least 7 business days before the next rollover date to prevent additional payments going through. Your cancellation will be processed in 7 business days. You can also access this form by going to "My Account" and finding the "Your Subscriptions" section. Your membership will continue for the duration you have paid for (as per your previous payment) and terminate on your next rollover date. If you are in arrears with your payments, payments will need to be finalised at the time of canceling.

b) We can cancel your membership at our discretion, if you breach these terms and conditions, if you are not participating in the spirit of the group, if you bring the reputation of Natalie Trusler and/or The Sewing Circle into disrepute, or if there are issues around your membership payments.

Membership Pricing

a) The price that The Buyer enters the membership, becomes their forever price for as long as they and Natalie Trusler continue the membership.

b) The Buyer can leave the membership at any time, however if they choose to return they will sign up at the current price of the membership.

Intellectual Property

a) All copyright, trademarks and other intellectual property rights in content on The Sewing Circle website are vested in Natalie Trusler of A.B.N. 33 481 638 609 (we, our or us). It is available at: www.natalietrusler.com and may be available through other addresses or channels.

b) The content of this Site is made available for you in your personal capacity and for your personal use only, and not for any commercial use. Personal use does not include sharing the guides or tutorials with groups of people, or in any online group or forum whether public or private (unless you have our express prior written consent).

c) As a member of The Sewing Circle, you understand and agree to the following statements:

i) You will not sell or teach any of Natalie’s creative tutorials or patterns, online or offline in any way. This includes not sharing video tutorials of the projects or creating kits etc.

ii) You will not share The Sewing Circle content such as printable patterns, instructional guides, material lists & video tutorials with anyone outside The Sewing Circle.

iii) You understand that you cannot sell the hand crafts that you create using Natalie’s tutorials or patterns online.

iv) If you would like to use Natalie’s patterns & tutorials to teach in your LOCAL sewing circles, you will need to upgrade your membership. Please email hello@natalietrusler.com for details of our terms. We'd love to discuss this with you.

d) Nothing in The Sewing Circle may be reproduced, redistributed, modified, published, transmitted, passed on, copied, used as teaching materials, or given to other people (clients, friends, colleagues or otherwise) without prior permission of the author. Such permission must be explicit and in writing.

e) You are not permitted to directly or indirectly copy, reproduce, transmit, distribute, publish, display, commercially exploit or create derivative works of the content of this site.

f) You may not use, share, post or repost Natalie Trusler or The Sewing Circle content in connection with, or to promote, other services or products in any other forum, whether online or otherwise, without our express written permission. Such permission must be explicit and in writing.

g) All the materials are for your personal use only and are not to be used in teaching, coaching, events, workshops, webinars, or elsewhere.

h) All rights are reserved. Everything is the intellectual property of Natalie Trusler (except where otherwise specified such as material from other authors clearly referenced). And it’s all protected by law.

i) The terms and conditions regarding use of materials apply upon registration for the program, while you are taking the program, and upon and after completing, withdrawing from or terminating the program.

Financial obligations

The Buyer is responsible for the completion of all payment plans associated with products they purchase. We reserve the right to seek recovery of any monies remaining unpaid via our Collection Agency.

Access and technology

a) If there are any problems with the website or if the host/network should go down due to circumstances beyond our control, Natalie Trusler shall not be held responsible. We will do our best to get the system back up as soon as possible when it is within our control.

b) Natalie Trusler shall not be liable to you or any other party as a result of any viruses or malware that may infect your or any other party’s electronic equipment.

c) You agree that you:

i) Will not use any robot, spider or other device, process or means to access The Sewing Circle

ii) Will not compromise or circumvent the security controls of The Sewing Circle or otherwise gain unauthorised access toThe Sewing Circle.

iii) Will not attempt to interfere with the proper working of The Sewing Circle.

Limited Liability

a) To the extent not prohibited by law, Natalie Trusler shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever arising from or in relation to your use of, or inability to use, the services provided in the The Sewing Circle, the delivery or failure to deliver any services, or failure to act of Natalie Trusler.

b) In the event that Natalie Trusler shall fail in accordance with these terms, our total liability in respect of all claims in connection with The Sewing Circle, and the Buyer’s exclusive remedy for breach of these terms, is limited to the total sum of your membership fees actually received by Natalie Trusler from the Buyer for the program.

c) In no event shall the aggregate liability for damages of Natalie Trusler arising from these terms whether by contract or tort exceed the amount/s the Buyer paid Natalie Trusler.

d) In addition to the above, the Buyer specifically agrees that Natalie Trusler DOES NOT:

i) Accept responsibility or liability for any loss suffered by the Buyer

ii) Assume responsibility or liability for the accuracy or completeness of content contained in the materials or links.

iii) Provide or arrange for any insurance for, or on behalf, of the Buyer

iv) Provide any indemnity for loss or injury suffered by the Buyer

v) Guarantee any results from this program, monetary or otherwise

vi) Guarantee continual access to the program, where such is outside of our control

Attestation

Natalie Trusler reserves the right to

a) Terminate access to any buyer who does not abide by these terms and conditions.

b) Pursue legal actions where its rights have been willingly and unlawfully infringed.

c) Terminate access without notice to any buyer whose payment is declined or in some way retracted or denied.

Financial Disclaimer

Individual results may vary. No guarantee is given as to specific results, financial or otherwise.

Privacy Policy

Natalie Trusler will not share your information with any third party without your consent, and it will only be used for administrative and notification purposes.

Lifetime of the Program

a) Natalie Trusler reserves the right to cease providing, hosting or offering The Sewing Circle at any time.

b) Should Natalie Trusler decide to cease offering The Sewing Circle, you will be notified via email and given the opportunity to access and download the materials (for you to keep for your personal use). It is your responsibility to do this. The materials will be kept online and available for a minimum of 30 days after the notification email has been sent.

c) If your email address has changed or you do not receive the email notifying you of this, Natalie Trusler will not be held responsible.

Other Provisions

a) When we communicate with you we will generally do so by email. You agree that email communications are contractually binding in the same way as properly signed and dated documentation sent by post.

b) Nothing in this agreement or on our websites (including https://natalietrusler.com) shall confer on any third party any benefit or obligation.

c) If any of these terms is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.

d) No waiver by us, in exercising any right, power or provision in this agreement shall operate as a waiver of any other right or of that same right at a future time; nor shall any delay in exercise of any power or right be interpreted as a waiver.

e) In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

f) We are not liable for any breach of our obligations resulting from causes beyond our reasonable control.

g) This Agreement shall be governed by and construed in accordance with the law of Queensland, and all international governance is expressly excluded.

h) You are deemed to have accepted these terms and conditions when you proceed with your purchase.
